9.21.2 Modifications to the closest prior art obvious to the skilled person
In T 1862/15 the board accepted that an alternative means for achieving a known technical effect could, in some cases, be considered to involve an inventive step. However, achieving a known technical effect by means of modifications of the closest prior art which would be obvious to the skilled person could not be considered inventive.
