What is the legal basis for conducting oral proceedings by VICO?

Administrative measures concerning oral proceedings, such as determining the form of oral proceedings, are within the organisational powers of the President of the EPO under Article 10(2)(a) EPC. Article 10(2)(a) EPC together with the decision of the President of the European Patent Office dated 22 November 2022 (OJ 2022, A103) provide a sufficient legal basis for the introduction of "VICOs by default".
