I am prepared to allow any person to use the invention as a licensee in return for appropriate consideration. How should I proceed?

You can file a "licence of right" statement, using EPO Form 7001. Your statement will be registered in the Register for unitary patent protection free of charge. Licences under this scheme are contractual agreements between the patent proprietor and licensee (Article 8(1) Regulation (EU) No 1257/2012). The Unified Patent Court is competent to handle disputes regarding compensation for licences granted on the basis of this scheme (Article 32(1)(h) UPC Agreement).

By filing such a statement, you will benefit from a 15% reduction of the renewal fees falling due after the statement's receipt (Rule 12(1) UPR). Any additional fees for late payment will also be calculated based on the reduced amount.

You should consider that if a licence of right is recorded, registering an exclusive licence will not be allowed unless you formally withdraw the statement. Similarly, if an exclusive licence is already registered or a request for one is pending, you will not be able to record a licence of right statement.

You can withdraw a license of right statement at any time using EPO Form 7002. However, you will have to reimburse the EPO for the full amount by which the renewal fees were previously reduced before the withdrawal becomes effective.
