PART IV – COMMON PROVISIONS
(1)The following provisions of the EPC, as amended, shall apply mutatis mutandis: Article 14, paragraphs 1 EPC, Article 14, paragraphs 3 EPC and Article 14, paragraphs 7 EPC; Article 113, paragraph 1 EPC; Articles 114 EPC, Articles 117 EPC, Articles 119 EPC, Articles 120 EPC, Articles 125 EPC; Article 128, paragraph 4 EPC; Articles 131 EPC, Articles 133 EPC; Article 134, paragraphs 1 EPC, Article 134, paragraphs 5 EPC and Article 134, paragraphs 8 EPC.
(2)The following provisions of the Implementing Regulations to the EPC, as amended, shall apply mutatis mutandis:
(a) Rules 1 EPC and Rule 2 EPC; unless otherwise provided Rule 3, paragraph 1 EPC, first sentence; Rule 3, paragraph 3 EPC; Rules 4 EPC and Rule 5 EPC;
(b) Rules 22 EPC to Rule 24 EPC;
(c) Rule 50, paragraphs 2 EPC and Rule 50, paragraphs 3 EPC;
(d) Rule 111, paragraph 1 EPC; Rules 112 EPC and Rule 113 EPC;
(e) Rule 115 EPC; Rule 116, paragraph 1 EPC; Rules 117 EPC to Rule 124 EPC;
(f) Rules 125 EPC to Rule 130 EPC;
(g) Rule 131 EPC; Rule 133, paragraph 1 EPC, subject to the proviso that the document referred to in that provision has been received no later than one month after expiry of the period; Rule 134 EPC;
(h) Rule 139, first sentence EPC, and Rule 140 EPC;
(i) Rule 142 EPC;
(j) Rules 144 EPC to Rule 147 EPC;
(k) Rules 148 EPC to Rule 150 EPC;
(l) Rules 151 EPC to Rule 153 EPC.
(3)When applying the provisions referred to in paragraphs 1 and 2 mutatis mutandis, the term "Contracting States" shall be understood as meaning the Contracting States to the EPC, except in Article 125 EPC, where it shall be understood as meaning the participating Member States.
(4)Where the present Rules, including the provisions of the EPC applicable mutatis mutandis under the present Rules, refer to "a period to be specified", this period shall be specified by the European Patent Office. Unless otherwise provided, a period specified by the European Patent Office shall be neither less than one month nor more than four months.
