Notice from the European Patent Office dated 19 April 2010 concerning updated Form 1001 (request for grant) and notes
Albania's accession to the European Patent Convention (see OJ EPO 2010, 96) has prompted a further update of the request for grant form (EPA/EPO/OEB 1001 04.10).
In this update (EPA/EPO/OEB 1001 05.10) we have taken the opportunity to dispense with the list of contracting states, to avoid the need for further updates each time a new country joins in the future. Under Article 79(1) EPC, all the contracting states party to the Convention at the time of filing of the European patent application are deemed to be designated in the request for grant, so the list in the form was purely for information.
The notes to Form 1001 (version 04.10) have also been revised. The updated (05.10) version no longer contains a list of wordings for the request for examination in all the admissible non-EPO languages, and for greater conciseness a number of editorial amendments have also been made.
