Notice from the European Patent Office dated 25 March 2009 concerning updated Forms 1001 (request for grant) and 1200 (entry into the European phase)
The request for grant form (EPA/EPO/OEB 1001) and the form for entry into the European phase (EPA/EPO/OEB 1200) have been updated in view of the new fee structure entering into force on 1 April 20091.
In the request for grant, the main change to the 01.092 version is the deletion from Section 31 – Designation of contracting states – of the option of designating individual contracting states, now that a flat-rate designation fee covering all the contracting states has been introduced. The same applies to corresponding Section 10 in the 01.083 version of the form for entry into the European phase, and the footnote for this section now also takes account of the accession of the former Yugoslav Republic of Macedonia4 to the European Patent Convention with effect from 1 January 2009.
Another change to Form 1200 reflects the additional fee for applications comprising more than 35 pages (Article 2, item 1a, RFees): Section 6 refers to a table, on page 7 of the form, in which the documents to be used for calculating any additional fee payable must be precisely indicated.
The notes on Forms 1001 and 1200 have been updated accordingly.
