INFORMATION FROM THE EPO
Notice dated 16 October 1992 concerning revised Form 1200
EPA/EPO/OEB Form 1200 and the corresponding Notes1, which have been revised, are reproduced below. Applicants are advised to start using this revised form immediately.
Comments on the amendments
This form differs from the previous version2 as follows:
- In Section 4 the applicant's attention is drawn to the altered legal position by the insertion of the words "Request for examination in an admissible non-EPO language (see Notes III, 6.2)". Following Decision G 6/91 of the Enlarged Board of Appeal, the examination fee is reduced only if the written request for examination in the admissible non-EPO language is filed at the same time as the request for examination in the official language of the EPO3.
- Section 6, which deals with the documents that are to form the basis for the European grant procedure when an application enters the regional phase before the EPO, has been simplified4.
- Section 8 takes account of new Rule 27a EPC5, concerning the requirements of European patent applications relating to nucleotide and amino acid sequences, which comes into force on 1 January 1993.
- Monaco6, Ireland7 and Portugal8 have been included in Section 10.1 and the Contracting States have now been placed in alphabetical order according to their country code, as in Form 1001 (Request for Grant).
The Notes have been revised accordingly.
