Rule 66 96
Examination of appeals
A revised version of the European Patent Convention entered into force on 13 December 2007. The provisions of the revised Convention apply unless the transitional provisions provide for the applicability of the EPC 1973. |
(1) Unless otherwise provided, the provisions relating to proceedings before the department which has made the decision from which the appeal is brought shall be applicable to appeal proceedings mutatis mutandis.
(2) 97 The decision shall be authenticated by the Chairman of the Board of Appeal and by the competent employee of the registry of the Board of Appeal, either by their signature or by any other appropriate means. The decision shall contain:
(a) a statement that it is delivered by the Board of Appeal;
(b) the date when the decision was taken;
(c) the names of the Chairman and of the other members of the Board of Appeal taking part;
(d) the names of the parties and their representatives;
(e) a statement of the issues to be decided;
(f) a summary of the facts;
(g) the reasons;
(h) the order of the Board of Appeal, including, where appropriate, a decision on costs.
