Corrigendum – legal provisions
The Intellectual Property Registration Directorate in the Republic of Malta's Ministry of Finance has drawn the EPO's attention to errors in some of the information given for Malta in the 14th (June 2009) edition of our "National law relating to the EPC" brochure.
In its Chapter III, as regards rights conferred by a European patent application after publication under Article 93 EPC, provisional protection under Article 67 EPC applies as from publication of the application, without a translation of the claims in one of Malta's official languages having to be filed.
In Chapter IV (translation requirements after grant), no fee is payable for filing a translation of the patent specification.
Therefore, column 3 in Table III.A should say "No", the information given in column 4 of Table III.A and columns 1 to 7 of Table III.B is to be ignored, and column 5 of Table IV should say "No" under (a) and "N/A" under (b).
Updating the "National law relating to the EPC" brochure
Users of the brochure (14th edition) should amend the above tables accordingly.
