Decision of the President of the European Patent Office dated 22 December 2004 concerning the content and form of the certificate for a European patent, and the procedure for issuing it
The President of the European Patent Office, having regard to Rules 54 and 62a EPC, has decided as follows:
Article 1
Form of the certificate for the European patent, and the procedure for issuing it
The certificate for the European patent as granted or amended shall be supplied to the proprietor in paper form. If there is more than one proprietor, a certificate shall be issued to each of them. Upon special request within the period under Rule 51(4) or under Rule 58(5) or (6) EPC, each proprietor shall be sent the certificate together with a copy of the patent specification. This request shall be free of charge. Additional copies of the certificate with the specification attached shall be issued to the proprietor upon payment of an administrative fee.
Article 2
Content of the certificate for the European patent
The certificate shall state the patent number and shall certify that the patent has been granted, to the persons named in the certificate, for the invention described and the states designated in the patent specification, or has been maintained in amended form.
Article 3
Entry into force
This decision shall enter into force on 1 April 2005, and shall apply to all European patent applications and patents in respect of which the communication under Rule 51(4) or 58(5) EPC is issued as from that date.
