Decision of the President of the European Patent Office dated 6 September 2001 implementing the Rules relating to Fees and amending the Arrangements for deposit accounts and their annexes
The President of the European Patent Office,
Having regard to Articles 5(2) and 10c of the Rules relating to Fees,
In view of the decision of the Administrative Council of 28 June 20011 amending the Rules relating to Fees in the light of the rounding down of EPO fees in euro,
HAS DECIDED AS FOLLOWS:
Article 1
The insignificant amount referred to in Article 10c of the Rules relating to Fees shall be fixed at EUR 10.
Article 2
The Arrangements for deposit accounts (ADA) and their annexes2 shall be amended as follows3:
1. Point 6.6, first sentence, ADA shall read as follows:
"6.6 The administrative fee shall be 30% of the amount not covered by the account, but shall not be less than EUR 50 or more than EUR 305."
2. Point 6.8(b), first half-sentence, ADA shall read as follows:
"(b) paid a surcharge of 10% on the relevant fee or fees, but not exceeding EUR 150;"
3. Point 9 of the Arrangements for the automatic debiting procedure (AAD, Annex A.1 to the ADA) shall read as follows:
"9. The administrative fee shall be 5% of the amount not covered by the account - but not less than EUR 50 or more than EUR 765 - for every decisive payment date affected."
4. Point 3.8 of the Arrangements for debiting deposit accounts by diskette (Annex B to the ADA) shall read as follows:
"3.8 The administrative fee shall be 5% of the amount not covered by the account, but shall not be less than EUR 150 or more than EUR 765."
Article 3
The fee amounts laid down in Article 2 of this decision shall be binding for payments as from 3 January 2002.
Article 4
This decision shall enter into force on 3 January 2002.
