Decision of the Administrative Council of 28 June 2001 amending the Implementing Regulations to the European Patent Convention
THE ADMINISTRATIVE COUNCIL OF THE EUROPEAN PATENT ORGANISATION,
Having regard to the European Patent Convention (EPC), and in particular Article 33(1)(b) thereof,
On a proposal from the President of the European Patent Office,
Having regard to the opinion of the Committee on Patent Law and of the Budget and Finance Committee,
HAS DECIDED AS FOLLOWS:
Article 1
Rule 107(1) EPC shall be amended to read as follows:
"Rule 107
The European Patent Office as a designated or elected Office - Requirements for entry into the European phase
(1) In the case of an international application as referred to in Article 150, paragraph 3, the applicant must perform the following acts within a period of thirty-one months from the date of filing of the application or, if priority has been claimed, from the priority date:"
Sub-paragraphs (a) to (h) shall remain unchanged.
Article 2
This decision shall enter into force on 2 January 2002 and shall apply to all international applications for which, on that date, the acts prescribed under Rule 107(1) EPC have not yet been validly performed and the time limit for doing so under Rule 107(1) EPC in its present form has not yet expired.
