Decision of the Administrative Council of 14 February 19851 amending Rule 85 of the Implementing Regulations to the European Patent Convention
THE ADMINISTRATIVE COUNCIL OF THE EUROPEAN PATENT ORGANISATION,
Having regard to the European Patent Convention (hereinafter referred to as the "Convention"), and in particular Article 33, paragraph 1 (b), thereof, On a proposal from the President of the European Patent Office,
HAS DECIDED AS FOLLOWS:
Article 1
The following new paragraph 4 shall be added to Rule 85 of the Implementing Regulations:
"If an exceptional occurrence such as a natural disaster or strike interrupts or dislocates the proper functioning of the European Patent Office so that any communication from the Office to parties concerning the expiry of a time limit is delayed, acts to be completed within such a time limit may still be validly completed within one month after the notification of the delayed communication. The date of commencement and the end of any such interruption or dislocation shall be as stated by the President of the European Patent Office."
Article 2
The President of the European Patent Office shall forward a certified copy of this Decision to all the signatory States to the Convention and to the States which accede thereto.
Article 3
This Decision shall enter into force on 10 December 1984.
