INFORMATION FROM THE EPO
Representation of nucleotide and amino acid sequences in patent applications and filing of sequence listings
The provisions for the representation of nucleotide and amino acid sequences in patent applications and the filing of sequence listings on electronic data carriers, which entered into force on 1 January 1993, were published in Supplement No. 2 to Official Journal No. 12/1992.
The supplement has been forwarded separately to subscribers to the Official Journal.
Important notice:
The new provisions apply to the following:
- European patent applications filed on or after 1 January 1993
- international applications filed on or after 1 January 1993
with the EPO as International Searching Authority
- Euro-PCT applications entering into the regional phase before the EPO as designated or elected Office, and whose international filing date is 1 January 1993 or later.
For applications with a filing date before 1 January 1993, the EPO will continue to operate the previous non-mandatory procedure. However, regarding the technical aspects of the presentation of sequence listings and the use of electronic data carriers, the Office recommends that applicants follow the rules set out in Annexes I and II to the Decision of the President of the EPO, published in Supplement No. 2 to OJ EPO 12/1992.
