Notice of the President of the EPO dated 10 January 1984 concerning the form of European patent specifications
Practice to date has been to indicate the title of the invention both on the title page and as a heading to the description in European patent specifications and in new European patent specifications issued in compliance with Article 103 EPC in opposition procedure. This has led to different wordings of the title appearing in different parts of the same patent specification, whenever the title has been amended in the processing of an application.
In order to avoid such a difficulty, it is hereby prescribed under Rule 53 and 62 in conjunction with Rule 49(1) EPC that all patent specifications transmitted to the printers as of 1 February 1984, will carry the title of the invention on the title page only.
This notice does not affect the provisions under Rule 27(1)(a) EPC to the effect that the description of patent applications must first state the title of the invention (cf. Guidelines for Examination in the European Patent Office, C-II, 4.2).
