Notice of the President of the EPO dated 10 March 1981, concerning the mention, on the cover page of the patent specification, of the existence in the file of technical information introduced after the application is filed
During the grant procedure an applicant may submit further technical information, for example comparative tests, further examples or a statement of the advantages offered by the invention. Technical information which extends beyond the content of the application as filed, however, cannot be included in the application by way of amendment (Article 123, paragraph 2, EPC and Guidelines for Examination in the EPO, C-VI, 5.3 to 5.8). This information is contained in that part of the file which is open to inspection (Article 128, paragraph 4, EPC).
The public will be notified of the existence of such information in the file by the following mention on the cover page of the patent specification:
"The file contains technical information submitted after the application was filed and not included in this specification."
