Patent litigation in Europe: Opposition at the EPO or request for revocation at the UPC. The pros and cons
This advanced lecture series is dedicated to examining current topics in patent litigation in Europe, including the launch of the UPC and the emergence of new European patent jurisprudence. The series feeds the content of and leads up to the annual Litigation Matters conference. Participants can attend each session separately or the entire series. It is organised by the EPO in co-operation with the European Patent Lawyers Association (EPLAW) and the European Patent Litigators Association (EPLIT).
This second lecture, entitled “Opposition at the EPO or request for revocation at the UPC: the pros and cons,” is to be held by Michael Wallinger. It will be followed by a Q&A session. Since the opening of the UPC on 1 June 2023, it has been possible to challenge a granted European patent either by filing an opposition with the EPO or, for the UPCA states, by filing a revocation action. Michael’s presentation will highlight the pros and cons of these procedures.

Dr Michael Wallinger

Dr.-Ing. Michael Wallinger holds a doctorate in mechanical engineering and has been admitted as a German Patent Attorney since 1987 and as a European Patent Attorney since 1988. Wallinger Ricker Schlotter Tostmann emerged from the patent law firm he founded in 1989, which operated as Wallinger and Partner from 1996 to 2007. Since 1983, Dr.-Ing. Wallinger has been involved in significant patent litigation involving a high triple-digit number of patent infringement, invalidity, and opposition cases.
