Alternative parts

Even if the alternative part is only one element in a larger whole, it might still qualify for design protection if its outward appearance is not dictated by its need to fit or match with that larger whole. For example, a designer has “freedom of design” when creating alternative wheels for a car, but has no such freedom to design the shape of the door: this can have only one shape or it would not fit. The part should be “ordinarily in view when in use” – e.g. not hidden under the bonnet – to typically qualify for design protection otherwise aesthetics are irrelevant.

If the alternative part has functional improvements which are novel and inventive, it may be patentable.
