Business processes

Business methods are not patentable under European patent law. This is because they aim to solve a business problem, not a technical problem – for example how to earn more profit. Running your business process on a computer (i.e. using technical means) does not, in itself, confer patentability.

If your business process – such as a pricing strategy or marketing plan – gives you an edge over your competitors, it may be best kept as a trade secret. Limit who has access to this business-critical information and ensure that they sign non-disclosure agreements.
