Decision of the Administrative Council of 8 June 1984 on the proportion of renewal fees for European patents to be remitted to the European Patent Organisation1
THE ADMINISTRATIVE COUNCIL OF THE EUROPEAN PATENT ORGANISATION
- having regard to Article 39(1) of the European Patent Convention,
- whereas pursuant to Article 40 of the Convention the amounts of the fees referred to under Article 38 EPC and the proportion referred to under Article 39 EPC must be fixed at such a level as to ensure that the revenue in respect thereof is sufficient for the budget of the Organisation to be balanced,
- whereas the financial planning of the Organisation indicates that this objective can be achieved if the proportion referred to under Article 39 is fixed at 50% for the long term,
- and taking into account the division of tasks, provided for in the Convention, between the European Patent Organisation and the central industrial property offices,
HAS DECIDED AS FOLLOWS:
The proportion of renewal fees for European patents to be remitted to the European Patent Organisation by the Contracting States shall be fixed at 50% with effect from 1 January 1985.
